Ninth Circuit Issues Major Opinion Affecting Student Organizations [3]

In a case called Alpha Delta Chi Delta Chapter FKA v. Reed [3], the Ninth Circuit had a chance to apply the holding from the U.S. Supreme Court decision in Christian Legal Society Chapter of the University of California, Hastings College of the Law v. Martinez.

In the latter case, the Supreme Court held “that a public law school does not violate the Constitution when it ‘condition[s] its official recognition of a student group—and the attendant use of school funds and facilities—on the organization’s agreement to open eligibility for membership and leadership to all students.’”In the current case, the Ninth Circuit had to address whether a more narrow nondiscrimination policy is constitutional.  The Court held:

San Diego State’s nondiscrimination policy, as written, is a rule of general application. It does not target religious belief or conduct, and does not “impose special disabilities” on Plaintiffs or other religious groups. Any burden on religion is incidental to the  general application of the policy. Thus, as written, San Diego State’s policy violates neither the Free Exercise Clause nor the Equal Protection Clause. However, given the evidence that San Diego State may have granted certain groups exemptions from the policy, there remains a question whether Plaintiffs have been treated differently because of their religious status. See Truth, 542 F.3d at 650. Therefore, we reverse the district court’s grant of summary judgment in favor of Defendants on Plaintiffs’ free exercise and equal protection claims. We remand for further findings as to whether San Diego State in fact exempted other student groups from the nondiscrimination policy, but refused to exempt Plaintiffs because of their religious beliefs.


Proposed House Bill Would Punish Institutions for Not Offering ROTC Credit [4]


A new bill would deny federal funds to 4-year institutions that do not offer at least 6 credit hours “to students enrolled in the institution for the successful completion of courses offered by a Senior Reserve Officers’ Training Corps program established under section 2102 of title 10, United States Code, without regard to whether the courses were completed at the institution.”The bill, called the Eliminating Disincentives to ROTC Participation Act (H.R. 2628), would become effective October 1, 2011 if it became law.


Moody’s Sounds the Alarm on Student Borrowing [5] (Hawaii Reporter)

A growing chorus of economists and educators think that the higher education industry will be America’s next bubble. Easy credit, high tuition, and poor job prospects have resulted in growing delinquency and default rates on nearly $1 trillion worth of private and federally subsidized loans.Now the ratings agency Moody’s has weighed in [6] with a chilling diagnosis: “Unless students limit their debt burdens, choose fields of study that are in demand, and successfully complete their degrees on time, they will find themselves in worse financial positions and unable to earn the projected income that justified taking out their loans in the first place.”


Should universities start selling beer at college sporting events? [7] (Midwest Sports Fans)

In this new era of college athletics, universities are beginning to realize that they need to do anything they can to make money.

A recent report by USA Today [8] highlighted the fact that more universities are looking for extra ways to make money, and that includes schools selling beer inside their stadiums. The way college sports have been reformed recently (TV contracts, conference networks, etc.) has created a free-for-all to earn revenue anyway they see fit.

With the disparity of money between teams in BCS conferences and non-BCS conferences, selling beer is a way for smaller schools to supplement income that they would normally not receive.
